DOLE: Pay Rules for October 31, November 1

Depart of Labor and Employment (DOLE) issued Labor Advisories on pay rules for special nonworking days as declared through Proclamation No. 50 signed by President Duterte.

Labor Advisory No.13: Pay Rules for October 31 and November 1

October 31 and November 1, 2017, as declared by President Duterte special nonworking days have the following pay rules issued by the DOLE, so that employers are guided in the computation of their employees’ payment of wages.


Rule 1. Employee has no work on that day: “No work, no pay” applies. Unless a company has a favorable policy, practice, or an agreement granting payment on such days (special nonworking days), an employee shall be paid.

Rule 2. An employee works on that day: An employee shall be paid an additional 30% of his or her daily rate on the first eight (8) hours of work.

(daily rate x 130%) + COLA = Rule 2

Rule 3. An employee renders overtime on that day: An employee shall be paid an additional 30% of his or her hourly rate on that particular day.

(hourly rate of the basic daily wage x 130% x 130% x number of hours worked) = Rule 3

Rule 4. An employee works on that day which is also his or her rest day: An employee shall be paid an additional 50% of his or her daily rate on the first eight (8) hours of work.

(daily rate x 150%) + COLA) = Rule 4

Rule 5. An employee renders overtime on that day which is also his or her rest day: An employee shall be paid an additional 30% of his or her hourly rate on that particular day.

(hourly rate of the basic daily wage x 150% x 130% x number of hours worked)
